Governor Ahmadu Umaru Fintiri has assented to the Adamawa State Districts Creation (Repeal and Re-enactment) Law 2022.
The Law which is to be cited as The Adamawa State Districts Creation (Repeal and Re-enactment) Law 2022 comes into effect from the 19th day of May 2022.
The Law therefore Repeals The Adamawa State Districts Creation Law No. 1 of 1992; The Adamawa State Districts Creation (Amendment) Law No. 3 of 1992 and The Adamawa Districts Creation (Amendment) Law No. 1 of 1996.
The Re-enacted Law which provides for the Appointment, Selection and Deposition of Districts Heads seeks to create additional Districts for State, provide for the appointment of Acting Districts Head and introduce new procedure for screening and selection of Districts Heads.
Subject to this Law or any other Law that may be enacted by the House, the Council shall continue to exercise such administrative powers and perform such functions in respect of Districts as are contained in the Local Government Law 1977 as amended.
A statement issued and signed by the Chief press Secretary to the governor, Humashi Wonosikou indicated that the Council shall have the powers to appoint Districts Heads, and selection shall be by tradition and custom of the area constituting the Districts and in the presence of a representative of the Council and such security agents as the Council may request, but where no traditional methods of selection exist, the Council shall constitute a Screening Committee to screen and clear candidates eligible for election.
The statement explained that in an atmosphere of perceived conflict, any aggrieved person who has sought to be selected or elected may within two weeks petition the Council.
The council also has powers to depose District Heads and discipline any found wanting whose conduct is being investigated for six months.
In the event where a District Head is deposed, it shall be final and Conclusively only if approved by the Governor and such approval shall be given within 30 days.
It could be recalled that the Adamawa State House of Assembly had earlier passed the Bill on April 13, 2022.
